Occupational safety and health is a valuable commodity. The respective regulations are fully applicable at universities, as well. The responsible authorities (Regional Council, Labor Inspectorate, Unfallkasse BW) monitor the implementation of occupational safety regulations at universities.

In the circular mail 03/2013 the Chancellor informed University members about the responsibilities for implementing occupational health and safety regulations at the University of Hohenheim.

Those with supervisory functions are responsible for matters of health and safety.

These are:

  • President
  • Deans
  • Managing Directors
  • Professors
  • Directors of central institutions and
  • Heads of department in the University Administration
  • Directors of scientific institutions (central scientific institutions, state institutes, research institutions, teaching institutions, museums, research stations, and research centers)
  • People who have been given explicit responsibility for an individual area (e.g. waste inspector, animal protection representative, representative for biological safety, radiation protection representative)

or people who take on supervisory functions while covering for others.

“The responsibility of supervisors goes only so far as the authority given to them. Responsibility ends where the supervisors’ means and authority end. However, they are required to notify their supervisor or the responsible person of defects which they cannot remedy on their own."

Defects in buildings

  • Responsibility: University Building Office
  • Information: from the Department of Construction and Property Management using a building permit

Defects with technical facilities connected to buildings

 

(this includes Electrical equipment, heating, air conditioning, ventilation systems, water, and waste water) insofar as the operation of these is formally the responsibility of the Technics and Domestic Services (AT) Department (see Number 4, Technical Department)

  • Responsibility: Department Technics and Domestic Services
  • Information: Technics and Domestic Services Department submits a damage notification to the University Building Office to remedy the defect.

If the defect has an effect on the occupational health and safety or there are safety obligations (e.g. legionella contamination), the responsible person will be informed directly and/or through the Occupational Health and Safety Department by the Technics and Domestic Services Department.

Those responsible for occupational health and safety must ensure the following in their area:

  • setting and monitoring the operational process
  • using employees according to their skills
  • instructing them about safe working procedures
  • talking to them if there is unsafe behavior
  • working together with the safety experts, company physician, the representative for occupational health and safety, and the Staff Council
  • Observance and implementation of all relevant legal regulations, official requirements, technical standards in the field of occupational health and safety and the  accident prevention regulations
  • and the assessment of the hazards associated with an activity, i.e. a risk assessment.

(1)

  • Ensuring that buildings and parts of buildings, facilities, and equipment are used in accordance with regulations (e.g. no fire loads in the main corridors and staircases, keeping escape routes clear, keeping fire doors closed, and compliance with the University of Hohenheim's fire protection regulations).
  • Determine hazards together with the Occupational Safety Expert and take measures to eliminate them.
  • Check the effectiveness of the occupational health and safety measures taken and improve or supplement them as necessary. 
  • Instruct employees of external companies commissioned by the facilities or institutes in the area of responsibility and arrange for their supervision.

  • The observance of the safety-compliant condition of operational equipment.
  • The safe and standard-compliant storage, transport, use, and disposal of materials, regardless of their aggregate state.
  • Observing and implementing the special regulations for the storage and transport of hazardous substances, genetically modified organisms, infectious materials, and ionizing agents.

  • The initiation of appropriate measures with regard to the prevention of hazards for people and the environment as well as for material assets.
  • The implementation of conditions imposed by the building authorities and the fire department of the city of Stuttgart to keep escape routes free of fire loads etc. (Consulting with the Occupational Safety Expert)

  • Written notification of defects and damage to buildings or parts of buildings, facilities, and equipment connected to the building at the Central University Administration Department of Construction and Property Management.
  • Written notification of defects in technical equipment to the Technical and Domestic Services Department.

(5)

  • Arranging for official permits to be obtained, registration or notification in the case of notifiable activities (work with biological agents, work with lasers, fumigation with formaldehyde, work with radioactive substances, work with narcotics, e.g. barbiturate or cannabis, etc.).
  • Arranging for official permits to be obtained, registering or reporting the storage of hazardous substances subject to notification (e.g. radioactive substances, etc.) and handling the same.
    The contact person is the Occupational Safety Expert.

pursuant to Sec. 6 of the Company Physician, Safety Engineers, and other Occupational Safety Experts Act

The occupational safety experts have the task of supporting the employer in occupational health and safety and in accident prevention in all matters related to occupational health and safety including humane working conditions.

In particular, they are to

1.) advise their employer and other persons responsible for occupational health and safety and accident prevention, in particular in the

  • a) planning, execution, and maintenance of operational facilities and social and sanitary facilities,
  • b) purchase of technical work materials and introduction of work processes and work materials,
  • c) selection and testing of personal protective materials,
  • d) design of workstations, work processes, working environment, and in other matters related to ergonomics,
  • e) evaluation of working conditions,

2.) monitoring the operational facilities and technical work equipment, in particular before start-up, and work procedures, in particular before they are implemented, in terms of safety,


3.) monitoring the implementation of occupational health and safety and accident prevention and, in connection with this,

  • a) to visit the workstations regularly and inform the employer or other person responsible for occupational health and safety and accident prevention about defects, suggest measures to remedy the defects, and work towards the implementation of these measures,
  • b) to ensure the use of personal protective equipment,
  • c) to investigate causes of accidents, report and evaluate on the results of the investigation, and to suggest to the employer measures to prevent these accidents,

4.) striving for all employees behaving in accordance with the occupational health and safety and accident prevention regulations, and in particular instructing them about the accident and health risks they are subject to at work as well as the institutions and measures to avert these risks, and to contribute towards the training of the safety representatives.
